(For End Users)

These Terms and Conditions (“Terms”) govern your use of the Goyant mobile application and related services operated by Goyant Private Limited (“Goyant”, “we”, “us”, or “our”). By downloading, installing, or using the Goyant App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the app.

1. Eligibility

To use the Goyant App, you must:

Be at least 16 years of age
Be legally capable of entering into a binding agreement
Provide accurate and complete registration information
Comply with all applicable laws in India and your location

2. Platform Role

Goyant is a tourism and hospitality discovery platform. Goyant does NOT:

Own, operate, or manage any hospitality businesses, moto rentals or taxis
Process or facilitate payments between users and service providers
Guarantee availability, quality, or safety of any listed business or service

Goyant acts as a technology intermediary connecting users with local businesses and service providers. All service agreements are directly between you and the respective business.

3. Account Registration

You agree to:

Provide accurate, current, and truthful information when registering
Keep your account credentials confidential
Notify Goyant immediately at legal@goyant.com if you suspect unauthorized access to your account
Not share your account with others or create multiple accounts

4. Use of the Platform

The Goyant App allows you to:

Discover hospitality businesses and local tourism experiences in India
Write reviews, post photos, and check in at venues
Connect with local business providers
Verify your identity for rental services via DigiLocker
Follow and interact with other users on the platform

5. Identity Verification for Rental Services

If you use moto rental or taxi services on the platform:

You may be required to verify your identity via government-approved portal (DigiLocker)
Your verified information (name, DL number, photo) will be shared with the service provider for the duration of the booking
You confirm that all documents provided are genuine and valid
Providing false identity documents is a serious violation and may result in account suspension and legal action

6. Location Sharing During Bookings

When you book a moto rental or taxi service:

You consent to sharing your live GPS location with the service provider for the duration of the booking
Location sharing is used solely for vehicle safety and service coordination
Location sharing ends when the booking is completed or cancelled
You may revoke location permission at any time via device settings, but this may affect the safety features of your booking and notified to local service provider

7. User-Generated Content

By posting reviews, photos, ratings, check-ins, or other content on Goyant, you:

Confirm that the content is your own original work and does not infringe any third-party rights
Grant Goyant a non-exclusive, royalty-free, worldwide licence to display and use the content on the platform
Agree not to post false, misleading, defamatory, or harmful content
Understand that your public content may be visible to other users and business partners

8. Prohibited Conduct

You must NOT:

Use the platform for any illegal activity
Post fake reviews, ratings, or misleading content
Create multiple accounts or impersonate other users
Attempt to hack, scrape, or reverse-engineer the app
Harass, abuse, or threaten other users or businesses
Share or misuse other users’ personal data obtained through the platform
Upload content that is offensive, obscene, or violates applicable Indian law

9. Third-Party Businesses and Services

Goyant lists businesses and service providers independently on the platform. Goyant:

Does not guarantee the quality, safety, or accuracy of any listed businesses
Is not responsible for disputes between you and any business or service provider
Does not mediate or take responsibility for transactions outside the platform

Your dealings with any business found through Goyant are solely at your own risk and discretion.

10. Payments

Currently, Goyant does not process any payment transactions between users and moto rental/ taxi businesses. All payments for services (rentals, bookings, food orders, etc.) are handled directly between you and the respective business.

In-app payment feature will be introduced in the future through recognised payment gateway for hospitality businesses.

11. Intellectual Property

All content on the Goyant platform — including the app design, logo, software, text, graphics, and features — is the intellectual property of Goyant Private Limited. You may not:

Copy, reproduce, or distribute any part of the platform.
Use Goyant’s name, logo, or branding without authorization.
Reverse-engineer or attempt to extract the source code of the app.

12. Disclaimer of Warranties

The Goyant App is provided “as is” and “as available” without warranties of any kind. Goyant does not guarantee:

Uninterrupted or error-free access to the platform
The accuracy or completeness of venue information listed on the platform
The quality, safety, or reliability of any listed business or service

13. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Goyant’s total liability to you for any claim arising from your use of the platform shall be limited to INR 1,000 (One Thousand Rupees).

Goyant is not liable for any indirect, incidental, special, or consequential damages including but not limited to loss of data, accidents during rentals, or disputes with service providers.

14. Indemnification

You agree to indemnify, defend, and hold harmless Goyant Private Limited, its directors, employees, and agents from any claims, losses, or expenses (including legal fees) arising from:

Your use of the platform or services
Your violation of these Terms
Your violation of any applicable law or third-party rights
Content you post on the platform

15. Account Suspension and Termination

Goyant may suspend or terminate your account if:

You violate these Terms or the Privacy Policy
You engage in fraudulent, harmful, or illegal activity
You provide false information during registration or identity verification
There are repeated complaints against your conduct on the platform

You may also delete your account at any time as described in Section 7 of the Privacy Policy above.

16. Changes to Terms

Goyant may update these Terms at any time. We will notify you of material changes via in-app notification or email. Continued use of the app after changes constitutes your acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Goyant platform shall be subject to the exclusive jurisdiction of the courts located in Benguluru, Karnataka, India.
